WHAT IS BANKRUPTCY?
Bankruptcy is a method of getting rid of bills from several types of unsecured debts. You can also stop harassing phone calls from debt collectors. There are different types of bankruptcy and depending upon which chapter you file under the rules vary and will require the expert knowledge of our Palm Beach Bankruptcy Attorneys!

WHAT IS A CHAPTER 7 BANKRUPTCY?
In its simplest terms this plan you hand over your assets to a trustee of the court and in exchange your debts are gone.

WHAT IS CHAPTER 13 BANKRUPTCY?
The Chapter 13 bankruptcy is sometimes called the "wage earner's" bankruptcy. This plan is intended to be used by most individuals, married couples, and small businesses.

I'VE MISSED MORTGAGE PAYMENTS, WILL I LOSE MY HOUSE?
By filing in for bankruptcy in either Chapter 7 or 13 we may be able to stall foreclosure while we come up with a plan to help you keep your house. In Chapter 7 filings there often is not a lot of time and secured property in general is not protected by this plan. So if keeping your house or financed car is a concern this may not be the best option but there are other factors to consider.

BILL COLLECTORS CALL ALL THE TIME, WILL BANKRUPTCY HELP ME?
The short answer is "Yes". As soon as you have hired our bankruptcy law firm you can tell all creditors to call your attorneys office and not to call you again. In fact Federal Law prohibits creditors from calling you or taking any action against you once they have been informed about your bankruptcy.  This applies to debts you've incurred prior to filing for bankruptcy. So after filing for bankruptcy you can begin answering your phone again.

WILL BANKRUPTCY RUIN MY CREDIT?
Let's face it, by the time you realize that you need protection from bankruptcy it is likely that you've missed a lot of payments so your credit is already in bad condition. So this concern is not a reason to avoid bankruptcy.

The bankruptcy will stay in your credit history records for ten years (possibly more in some circumstances).  After this time has past most most people are able to credit again. Although it may be true that the terms of the new credit may not be good this is only partly due to the bankruptcy and additionally due to the missed payments prior to the bankruptcy.

On the other hand if file under Chapter 13 then during the time that the repayment plan is in effect you may not acquire any new credit without the permission of the Chapter 13 Trustee. The Trustee may not unreasonably refuse permission.
